Article 1: General provisions

The e-commerce website of High Glow Candles, a sole proprietorship with registered office at Vijverstraat 22 9620 Zottegem, offers its customers the opportunity to purchase the products from its webshop online.

These General Terms and Conditions ("Terms") apply to any order placed by a visitor to this e-commerce website ("Customer"). Article 3: Offer

Article 4: Online purchases

To purchase a product, the Customer can make a selection on the website and add the chosen products to the shopping cart. After clicking on the shopping cart, the Customer can see an overview of the order. After the Customer has entered his / her address details, the Customer can proceed to the step to checkout.

The Customer can choose between the following payment methods:

High Glow Candles is entitled to refuse an order due to a serious shortcoming of the Customer with regard to orders in which the Customer is involved. 

Article 5: Delivery and execution of the agreement

After the order has been placed, and the corresponding payment has been received by High Glow Candles, the order is produced. High Glow Candles allows 6 working days for the order to be shipped. This period of 6 working days does not apply when an ordered item is not in stock or during holiday periods. The Customer will be informed of this as soon as possible.

Items ordered through this webshop are delivered in Belgium and the Netherlands. The articles can also be sent to other countries, at the request of the customer. To do this, the customer must contact High Glow Candles at highglowcandles@gmail.com before placing the order to check the possibilities.

The delivery is done by BPost and PostNL, or another delivery service if it is sent to another country. If the delivery must take place in Zottegem (zip code 9620), the order will be delivered personally.

High Glow Candles allows 6 working days before the order is passed on to the delivery service. The effective delivery date is determined by the delivery service: the customer is informed of this by a track & trace code. When delivered in Zottegem (postal code 9620), the order will be delivered personally. There is no track & trace code available, but the customer is notified in advance of the delivery date.

Any visible damage and / or qualitative shortcoming of an article or other shortcoming in delivery must be reported immediately by the Customer to High Glow Candles, via highglowcandles@gmail.com.

The risk of loss or damage is transferred to the Customer as soon as he (or a third party designated by him, who is not the carrier) has physically taken possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by High Glow Candles.

 

Article 6: Retention of title

The delivered items remain the exclusive property of High Glow Candles until full payment has been made by the Customer.

The Customer undertakes, if necessary, to inform third parties of the retention of title of High Glow Candles, for example to anyone who would seize the articles not yet fully paid for.

Article 7: Right of withdrawal

The provisions of this article only apply to Customers who, in their capacity as consumers, purchase articles online from High Glow Candles.

The Customer has the right to withdraw from the agreement within 14 calendar days without giving reasons.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the good.

To exercise the right of withdrawal, the Customer must inform High Glow Candles (highglowcandles@gmail.com) by e-mail of his decision to withdraw from the contract by means of an unambiguous statement.

To meet the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to High Glow Candles immediately, but in any case no later than 14 calendar days after the day on which he has communicated his decision to withdraw from the agreement to High Glow Candles: Vijverstraat 22 9620 Zottegem. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods will be borne by the Customer.

If the returned product is in any way diminished in value, High Glow Candles reserves the right to hold the Customer liable and claim compensation for any diminished value of the goods resulting from the use of the goods by the Customer going beyond what is necessary to determine the nature, characteristics and functioning of the goods.

Only items that are in the original packaging, together with all accessories, invoice or proof of purchase can be taken back.

If the Customer cancels the agreement, High Glow Candles will refund all payments received from the Customer up to that time, including the standard delivery costs, to the Customer within a maximum of 14 calendar days after High Glow Candles has been informed of the Customer's decision. to withdraw from the contract. In the case of sales agreements, High Glow Candles may withhold the refund until it has received all goods back, or until the Customer has demonstrated that he has returned the goods, whichever is the earlier.

Any additional costs resulting from the choice of the Customer for a different method of delivery than the cheapest standard delivery offered by High Glow Candles will not be refunded.

High Glow Candles reimburses the Customer with the same payment method with which the Customer carried out the original transaction, unless the Customer has explicitly agreed otherwise; in any case, the Customer will not be charged for such reimbursement.

The Customer cannot exercise the right of withdrawal for: the delivery of goods manufactured according to the Customer's specifications, or which are clearly intended for a specific person. If the customer chooses to request other specifications in the product than the standard options available on the web shop, the customer's right of withdrawal will lapse.

Article 8: Warranty

Under the law of 21 September 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

In order to invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer's home, the Customer must contact High Glow Candles customer service and return the item to High Glow Candles at his expense.

If a defect is found, the Customer must inform High Glow Candles as soon as possible (via highglowcandles@gmail.com). In any case, any defect must be reported by the Client within a period of 2 months after its determination. Afterwards, any right to repair or replacement lapses.

The (commercial and / or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or changes to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase, or if applicable, delivery, are deemed not to be hidden defects, unless the Customer proves otherwise.

Article 10: Penalties for non-payment

The order will not be produced and shipped until full payment has been received by High Glow Candles.
